Appeals of Denied School Transfer Requests 


 

Louisiana Revised Statute 17:4035.1 allows parents to enroll their children in a public school of their choice if the following apply:

  • The public school in which the student was most recently enrolled, or would otherwise attend, received a school performance letter grade of "D" or "F" for the most recent school year.
  • The school in which the student seeks to enroll received a school performance letter grade of "A", "B", or "C" for the most recent school year and has sufficient capcity at the appropriate grade level. School and grade level capacity are determined by Local Educational Authorities (LEAs).
  • The transfer does not violate the order of a court of competent jurisdiction.

School performance letter grades are available online at the Louisiana Department of Education website. The Local Educational Authority will also notify parents of students in schools that received a "D" or "F" rating of the transfer process, including a list of schools within the district that received an "A", "B", or "C" performance rating.

 


 

Appeal of Denied School Transfer Request

School transfer requests are to be submitted to the local district office, in compliance with corresponding local district policies.

In the event that a transfer request is denied by the LEA, the denial may be appealed to BESE, according to the following procedure:

  • Print and complete the School Transfer Request Denial Appeal Form, linked below.

  • Attach a copy of the official LEA denial of the student transfer request.

  • Submit the form, via certified mail, beginning April 1st through May 15th annually, for eligible student transfer for the subsequent school year to:

  • Requests will be evaluated within 90 days of acknowledgement and no later than the annual June meeting of BESE.

  • Per LA R.S. 17:4035.1, requests will not qualify for consideration or be approved for appeal for the following instances:

    • The student transfer request would result in the school or classroom exceeding enrollment capacity;
    • The student transfer request is submitted to or denied by the LEA, outside of the LEA transfer request period, per the LEA policy regarding a student transfer;
    • The school in which the student seeks to transfer to or from does not meet eligibility requirements;
    • The student transfer request violates an order of a court of competent jurisdiction.
